1. Introduction and Definitions

These Terms of Use (hereinafter: the “Terms”) apply to all use of the website www.city-unlock.com (hereinafter: “CityUnlock”, the “Website”) owned by Fairy Latina, sole proprietorship, owned by Lauro Portada, OIB: 74619539427, Paških rektora 8, 23250 Pag (hereinafter: the “Trade”).

The Buyer is any person who accesses the Website with the intent to use the services and/or purchase digital products offered on the Website.

By purchasing a digital product on the Website, the Buyer confirms that they have read, understood, and accepted these Terms of Use in advance, thereby concluding a valid electronic contract between the Buyer and the Trade.

The offered digital products do not constitute services in the conventional sense, but rather content that the Buyer uses independently on their own device, without the assistance of the Trade or the physical presence of any third party.

2. Description of Service

The Trade does not provide any touristic, guiding, animation, or other service-based activities.

All products offered on the Website are strictly digital products for personal, independent use, without the physical presence of a guide or game master.

The Trade facilitates and conducts the sale of digital products via the website www.city-unlock.com and associated pages.

The Trade enables the Buyer to easily browse currently available digital products and to purchase them online.

After purchase, the Buyer receives a unique, one-time-use activation code with a time-limited access window, as described in the product description.

The activation code is delivered exclusively via email to the address provided by the Buyer during payment. The Buyer is responsible for the accuracy of the submitted email address.

3. Payment Method

Payment is processed via the secure Stripe system.

Buyers may pay using bank cards (Visa, Mastercard, Maestro, and other cards accepted by Stripe).

The Buyer is responsible for ensuring that the submitted information is correct and that the card contains sufficient funds to successfully complete the transaction.

4. Invoice Issuance

After a successful payment, the Buyer automatically receives an invoice in electronic form, delivered to the email address entered during payment.

The Buyer is responsible for the accuracy of the data entered at the time of purchase.

Invoices are issued in accordance with the applicable regulations of the Republic of Croatia.

5. Right of Withdrawal and Refund

By purchasing a digital product, the Buyer expressly agrees that the delivery of digital content will begin immediately upon payment, thereby confirming and acknowledging that they waive the right to unilaterally withdraw from the contract within 14 days, in accordance with Article 86, Paragraph 1, Point 13 of the Consumer Protection Act (“Narodne novine” No. 19/2022, 59/2023).

The Trade enables access to the content immediately after the payment is completed, and for that reason, refunds are not possible once the activation code has been sent to the Buyer’s email address.

6. Use of Activation Code and Number of Devices

After purchase, the Buyer receives a unique activation code that grants access to the purchased content (tour or game) and is valid exclusively for private, one-time use.

• Tour codes may be used on up to 5 devices.
• Escape game codes are valid for up to 6 devices (short version) or 8 devices (long version), depending on the type of game purchased.

The code is considered used at the moment of first activation.

Any sharing of the code beyond the specified limits, attempts at multiple uses, system manipulation, content recording, or any other unauthorized use shall be considered a violation of these Terms and may result in immediate termination of access without the right to a refund, as well as further legal action.

7. Technical Responsibility of the User

The Buyer is responsible for possessing a functional device, a stable internet connection, and the basic technical capabilities to access the content.

CityUnlock is not liable for access issues caused by the Buyer’s technical difficulties, including but not limited to device settings, email delivery problems, internet connectivity, battery level, browser compatibility, or other circumstances beyond the platform’s control.

8. Use of the Website

By using the Website, the Buyer is granted a limited and non-transferable right to access the digital content strictly for personal, non-commercial purposes, in accordance with these Terms of Use and applicable laws of the Republic of Croatia.

The Buyer agrees not to:

• Attempt to retrieve, copy, modify, or analyze the system’s source code,
• 
  
• Sell, resell, assign, rent, or distribute codes, access data, or content without prior written consent,
• Disrupt or attempt to disrupt the operation of the system, including its technical, security, and infrastructure components.

9. Security and Prohibition of Technical Abuse

The Buyer agrees not to attempt unauthorized access to the system, modify, intercept, or distribute content, activation codes, or any other elements of the platform.

Any attempt at technical manipulation, automated use of the system, or disruption of the Website’s operation shall be considered abuse and may result in permanent loss of access without the right to a refund, as well as potential civil or criminal proceedings.

10. Intellectual Property

All content published on the Website (including, but not limited to, texts, photographs, audio recordings, videos, graphics, design, maps, names of tours and games, as well as all other digital elements) is protected by the Copyright and Related Rights Act of the Republic of Croatia and relevant EU legislation and is the exclusive property of Fairy Latina, sole proprietorship, owned by Lauro Portada, OIB: 74619539427, Paških rektora 8, 23250 Pag, or is used with the explicit permission of the rights holder.

Any unauthorized use of content is strictly prohibited, including:

• Copying, recording, sharing, or distributing content without prior written consent,
• 
  
• Publishing or selling activation codes to third parties,
• Modifying, adapting, transferring, or using content for commercial purposes.

Any such violation constitutes a serious infringement of copyright and related rights and may result in civil and/or criminal proceedings in accordance with the laws of the Republic of Croatia and the European Union.

11. Limitation of Liability and Indemnification

Use of the Website, including all tours and escape games, is done entirely at the user’s own risk.

Fairy Latina, sole proprietorship, owned by Lauro Portada, OIB: 74619539427, Paških rektora 8, 23250 Pag, shall not be held liable for any damage, loss, accident, injury, delay, technical issue, access interruption, or any other consequence arising from the use of the content, particularly while walking through the city or viewing the device screen.

The Buyer agrees to indemnify and hold harmless the platform owner, Website, and Trade from any third-party claims, damages, or expenses (including reasonable legal fees) that may arise from violation of these Terms of Use or misuse of the system.

By using the content, the Buyer waives any claim for compensation against the Trade for technical difficulties beyond the Trade’s control.

12. Termination of Use and Access Restriction

The Trade reserves the right to unilaterally and without prior notice disable access to the Website, specific content, or an activation code in the event of:

• Violation of these Terms of Use,
• 
  
• Attempted misuse (e.g., sharing the code beyond the allowed number of devices),
• Technical manipulation of the system or content,
• 
  
• Any behavior that, at the Trade’s discretion, harms the integrity or security of the platform.

In such cases, the Buyer has no right to a refund or compensation of any kind.

13. User Account Registration

Registration of a user account is not required for the purchase of digital products offered on the Website.

After purchase, the Buyer is issued an activation code to access the content without the need to create a user account.

The code is valid on a limited number of devices, as specified in the product description.

14. Changes to the Terms

The Trade reserves the right to amend these Terms of Use at any time, without prior notice.

Buyers are encouraged to periodically check this page to stay informed of any changes.

Continued use of the Website after changes are published shall be considered as acceptance of the updated Terms by the Buyer.

All amendments will be published on this page and shall take effect on the date of publication.

15. Final Provisions

Section titles in these Terms of Use are provided solely for ease of reference and do not affect the interpretation of their content.

If any part of these Terms becomes invalid, unlawful, or unenforceable, this shall not affect the validity or enforceability of the remaining provisions.

Failure to exercise any right or provision by the platform owner, the Trade, or the Website shall not constitute a waiver of that right.

The registered seat of Fairy Latina, sole proprietorship, owned by Lauro Portada, OIB: 74619539427, Paških rektora 8, 23250 Pag, is located in the Republic of Croatia, and all legal relations are governed by Croatian law.

For any disputes arising from the use of the Website, exclusive jurisdiction lies with the competent court in Zadar.

These Terms of Use enter into force on the date of publication on the Website.
